Terms and Conditions of Service

1. Introduction and Acceptance of Terms

Tree Surgeon Operations, LLC ("Tree Surgeon Operations," "we," "us," or "our") is a limited liability company registered in the State of Oklahoma. By using our website, requesting an estimate, accepting an invoice, or engaging in our services in any capacity, you ("Client," "you," or "your") affirmatively agree to be bound by these Terms and Conditions. If you do not accept these terms in full, you are not authorized to access or use our services. These Terms are subject to change at any time without prior notice. Continued use of our services after any changes shall constitute your consent to such changes.

2. Scope of Services

Tree Surgeon Operations provides a wide variety of tree-related services including, but not limited to, trimming, pruning, removals, land clearing, stump grinding, and emergency response. All services are offered at our sole discretion and are subject to safety assessments, availability, and regulatory compliance. We reserve the right to decline any service request, estimate, or scheduled job without explanation.

3. Estimates, Proposals, and Change Orders

All estimates provided prior to visiting the property are considered non-binding and purely informational. The issuance of a formal invoice constitutes the only binding service offer. Once sent, the invoice must be expressly accepted by the Client (in writing or by payment) to form a binding agreement. We prefer to maintain consistent pricing but reserve the right to alter pricing where site conditions or project scope has changed. Similarly, Clients are expected to uphold their agreed-upon obligations without deviation unless both parties consent in writing. Change orders typically incur additional charges.

4. Scheduling, Cancellations, and Weather Delays

Scheduling is based on logistical and seasonal constraints. We will make a reasonable effort to honor appointment dates. However, Tree Surgeon Operations shall not be liable for rescheduling due to weather, utility interference, regulatory delays, labor limitations, or any force majeure event. If a Client cancels service within 24 hours of a scheduled appointment, we reserve the right to charge a $150 mobilization fee. Should conditions on-site pose a danger or violation of law, we reserve the right to cancel or modify service without liability.

5. Customer Responsibilities

The Client is responsible for providing:
(a) unobstructed access to all relevant work areas;
(b) accurate disclosure of property ownership and boundaries;
(c) proper marking and notification of underground utilities, septic tanks, sprinkler systems, invisible fencing, or other concealed hazards;
(d) all required permits, HOA permissions, and/or municipal authorizations, unless expressly contracted otherwise.
Failure to provide this information may result in damages for which Tree Surgeon Operations assumes no liability.

6. Payment Terms

Unless expressly agreed in writing, payment is due immediately upon completion of the service. An invoice will be sent via email. Clients will be reminded of unpaid balances at 3, 7, and 14 days. After 14 days, a late fee of $35 or 1.5% of the invoice total (whichever is greater) will be assessed. We reserve the right to file a mechanic's lien against the serviced property for unpaid invoices, including fees and interest.

Accepted methods of payment include cash, check, debit/credit cards, and ACH. Card payments are processed through Stripe and incur a 3% processing fee. Tree Surgeon Operations may permit NET 30 terms for approved commercial or nonprofit accounts by written agreement.

All sales are final. Refunds are issued only under exceptional circumstances as determined by us at our sole discretion.

7. Limitations and Disclaimers

Tree Surgeon Operations offers no guarantee as to the health, survival, or condition of trees serviced, as living organisms are subject to unpredictable biological and environmental changes. Cosmetic damage (e.g., tire marks, sawdust, root disturbances) is a natural consequence of many services and shall not constitute grounds for dispute.

We are not liable for damages to driveways, lawns, or underground infrastructure not disclosed in advance. If subcontractors or external equipment providers are engaged for part of the service, Tree Surgeon Operations shall remain the principal and ensure proper oversight.

8. Legal Compliance and Disputes

These Terms and any associated agreement shall be governed by and construed under the laws of the State of Oklahoma. Disputes shall be resolved first through informal negotiation. If unresolved within 30 days, parties agree to submit to binding arbitration in Oklahoma County. Either party may pursue claims in small claims court as appropriate.

9. Privacy Policy

We collect information you provide directly through our forms and communications. This includes your name, contact information, address, and service-specific details. We also use Stripe to handle payment processing. We do not store credit card data.

We use minimal cookies and analytic tracking to improve our services. We do not sell, lease, or disclose your information except as required to provide service or comply with legal obligations. This site is not intended for individuals under 18. Links to third-party websites are used at your own risk. We strive to meet CCPA principles in good faith, but as a small operator, we maintain minimal records and respect verified data requests.

10. Entire Agreement and Enforceability

These Terms, together with any formal invoice, change order, or signed agreement, constitute the entire agreement between the Client and Tree Surgeon Operations. If any provision is deemed unenforceable by a court or arbitrator, the remaining terms shall remain in full force.
